Terms of service

These Terms & Conditions govern the sale of Aeropick products and set out the rights and responsibilities of both the customer and the seller.

1. Purpose

These Terms & Conditions govern the sale of Aeropick products through Aeropick.com. By placing an order through the website, the customer agrees to these Terms & Conditions. These Terms & Conditions apply to all purchases unless mandatory consumer protection laws applicable in the customer's country of residence provide otherwise.

2. Definitions

For the purposes of these Terms & Conditions:

Aeropick means the Aeropick brand operated by W&T SAS.

Customer means any individual or legal entity purchasing products through Aeropick.com.

Product means any product offered for sale through Aeropick.com.

Website means Aeropick.com.

Edition means a defined ordering period during which selected products are available for purchase before production begins.

3. Seller

All products are sold by:

W&T SAS
France

W&T SAS is the contracting party for every order placed through Aeropick.com and is responsible for customer service, order management and after-sales support.

Products are manufactured in Italy and dispatched through Aeropick's logistics partner. These operational arrangements do not affect the identity of the seller.

4. Products

Aeropick designs and manufactures products for musical instruments and the spaces around them.

Product descriptions, photographs, dimensions, finishes and specifications are presented as accurately as reasonably possible.

Minor variations resulting from handcrafted production, natural materials or normal manufacturing tolerances do not constitute defects.

Because every product is handcrafted, slight variations between individual pieces are part of the character of the product.

5. Editions & Pre-orders

Aeropick operates through controlled editions rather than continuous production. Products are not manufactured in advance or held as finished inventory.

Each edition remains available for a defined ordering period. Once the edition closes, production begins based on confirmed customer orders. Once an edition has closed, no further orders are accepted for that edition.

Estimated production and delivery dates are provided in good faith but remain estimates. If production or delivery is affected by circumstances outside Aeropick's reasonable control, customers will be kept informed throughout the process.

6. Availability

Availability is limited to the countries listed on Aeropick.com at the time an order is placed. Aeropick reserves the right to add or remove delivery destinations at any time. Orders may be declined where legal, operational or logistical constraints prevent fulfilment.

7. Prices

All prices displayed on Aeropick.com are shown in the currency applicable to the customer's selected market. Prices include Value Added Tax (VAT), sales tax or equivalent consumption taxes where applicable.

For destinations where import duties or customs charges apply, these amounts are calculated during checkout whenever applicable and shown before the customer completes the purchase.

Prices may change between editions but will never affect orders that have already been confirmed.

8. Payment

Payment is collected at the time the order is placed. Orders are not confirmed until payment has been successfully authorised.

Payments are processed by Aeropick's authorised payment providers. Payment information is encrypted and is never stored by Aeropick.

9. Order Confirmation

Following successful payment, the customer receives an order confirmation by email. The order confirmation acknowledges receipt of the order and summarises the products purchased.

If Aeropick is unable to accept an order for any reason, the customer will be informed promptly and any payment received will be refunded in full.

10. Order Changes & Cancellations

Customers wishing to modify or cancel an order should contact Aeropick as soon as possible. Aeropick will make reasonable efforts to accommodate requests received before production begins.

Once production has commenced, modifications or cancellations may no longer be possible. Nothing in this section limits any statutory consumer rights applicable under mandatory law.

11. Shipping

Orders are dispatched from Italy through Aeropick's logistics partner. Unless otherwise stated during checkout, orders are shipped on a Delivered Duty Paid (DDP) basis.

Where applicable, duties, customs charges and import taxes are calculated during checkout and included in the total amount payable before the order is completed. This means customers should not normally be required to pay additional customs charges upon delivery.

12. Delivery

Estimated delivery times are communicated on the website and in the order confirmation. Delivery dates are estimates and are not guaranteed.

Aeropick is not responsible for delays caused by customs authorities, carriers, weather events or other circumstances beyond its reasonable control. Customers receive shipment tracking once their order has been dispatched.

13. Inspection Upon Delivery

Customers are encouraged to inspect their order promptly after delivery. If the product or packaging appears damaged during transport, Aeropick should be contacted as soon as possible and, where reasonably possible, within 48 hours of delivery.

Customers should retain the original packaging until the claim has been reviewed. Photographs and a short video of the product, packaging and damage may be requested to assist with the assessment.

14. Returns

Returns are governed by the Aeropick Returns Policy. Customers must contact Aeropick before returning any product. Return instructions will be provided once the request has been reviewed.

15. Guarantee & Repairs

Guarantees, repairs and after-sales support are governed by the Aeropick Guarantee & Repairs Policy, which forms part of these Terms & Conditions.

16. Product Care

Customers should follow the Product Care guidance published by Aeropick. Damage resulting from misuse, neglect, improper storage or failure to follow the Product Care Policy may affect the remedies available under applicable consumer protection law.

17. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded under applicable law. Subject to mandatory consumer protection legislation, Aeropick shall not be liable for indirect or consequential losses arising from the purchase or use of its products.

18. Force Majeure

Aeropick shall not be responsible for delays or failures resulting from events beyond its reasonable control, including but not limited to natural disasters, fire, strikes, transport disruption, supplier failure, governmental action, epidemic, pandemic or other unforeseen events.

Where such circumstances materially affect production or delivery, customers will be informed as soon as reasonably practicable.

19. Governing Law

These Terms & Conditions are governed by French law, without prejudice to any mandatory consumer protection rights applicable in the customer's country of residence. Nothing in these Terms & Conditions limits any rights granted to consumers under mandatory applicable law.

20. Dispute Resolution

In the event of a dispute, the customer is encouraged to contact Aeropick directly to seek an amicable solution.

Failing that, the customer may refer the matter, free of charge, to Aeropick's designated consumer mediator, AME CONSO, within one year of their written complaint, via www.mediationconso-ame.com or by post at AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris.

21. Intellectual Property

All content published on Aeropick.com, including text, photographs, videos, graphics, logos, product designs, trademarks and other materials, is the property of Aeropick or its licensors and is protected by applicable intellectual property laws.

Nothing in these Terms & Conditions grants any right to reproduce, distribute, modify or commercially exploit any part of the website or Aeropick products without prior written permission.

The purchase of an Aeropick product transfers ownership of the physical product only. No intellectual property rights are transferred.

22. Privacy

Aeropick is committed to protecting customers' personal information. Personal data is collected and processed only for the purposes of managing customer accounts, processing orders, providing customer support and complying with applicable legal obligations.

Further information regarding the collection, processing and storage of personal data is available in the Aeropick Privacy Policy.

23. Changes to these Terms & Conditions

Aeropick may update these Terms & Conditions from time to time to reflect changes in legal requirements, business operations or customer services.

The version published on Aeropick.com at the time an order is placed applies to that order. Any subsequent changes apply only to future purchases unless required by law.

24. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted, to the extent possible, in a manner consistent with its original intent and applicable law.
